The Mecelle was the civil code of the Ottoman Empire in the late 19th and early 20th century. It was the first attempt to codify a part of the Sharia -based law of an Islamic state. The code was prepared by a commission headed by Ahmed Cevdet Pashaincluding a large team of scholars, issued in sixteen volumes containing 1, articles from to and entered into force in the year In its structure and approach it was clearly influenced by the earlier European codifications.
Covering most areas of civil lawit exempted family lawwhich remained a domain of religious law. It has been praised as the first successful attempt to render Hanafi fiqh into legal civil code comprehensible to the layperson and not just to scholars.

The substance of the code was based on the Hanafi legal tradition that enjoyed official status in the Empire, put into European code-form. However, using the method of preference tahayyurit also incorporated other legal opinions that were considered more appropriate to the time, including from non-Hanafis.
As the Mecelle was eventually applied in the secular nizamiye courts as well as in the Sharia courts of the Empire, Jews and Christians were for the first time subjected to Islamic law instead of their own law, but could now be called as witnesses in court.
After the dissolution of the Ottoman Empire following World War Ithe Mecelle remained a lasting influence in most of its successor states except Egyptwhere it was never in force. The Mecelle was long-lasting in most places since it was effective, coherent, and difficult to dislodge.
It remained in force:. The Mecelle also remained the basis of civil law in Jordan and Kuwait. The first book of the Mecelle is composed of seven chapters that focus on the jurisprudence and codification of laws regarding sale. These include standards of contracts, the subject matter of sales, matters relating to price, giving and taking delivery, and various categories of things sold and the effect thereof. Book 2 is the legal codification of circumstances dealing with hire renting.
This book contains general hire specifications, questions relating to the contract of hire, questions relating to the amount of the hire, period of the hire, type of thing hired and matters relating thereto, rights and obligations of person giving and person taking on hire after the conclusion of contract, and matters of compensation.
Book 3 deals with legal guarantee. This includes matters of contractual agreement and release from a contract of guarantee. A pledge consists of setting aside property from which it is possible to obtain payment or satisfaction of some claim. Such property is then said to be pledged, or given in pledge. Book 5 includes the fundamental basis of the contract of the pledge, stipulations of the pledgor and pledgee, fundamental rules relating to the pledge, and sale of the pledge.
This book contains all legal information regarding trusts and trusteeship. A trust involves something that is entrusted to one person from another person for safe keeping. Trusts can also involve the loaning of something for use, meaning that the one accepting the loan is to enjoy use in the subject of the trust.It provides a platform that not only enhances Arabic language learning opportunities on campus, but also provides a space for students to situate their own experiences in a uniquely Arabic context.
Each year, students submit original Arabic works on Arabic culture, current events, travel, history, pop culture, academic writing, creative writing, fiction, poetry, and photography. So far, we have published three issues of UChicago Majalladebuting in the Fall of and continuing up to now. Beginners are encouraged to work with more advanced students to co-author articles, and in many cases receive direct feedback from the magazine editors.
Perhaps the most unique feature of our magazine? An editorial board and team of undergraduates edit each submission before it goes to print. Here, too, is an opportunity for students to engage with the Arabic language: the feedback students receive on their submissions can inform their future engagements with Arabic writing, and editors can benefit from delving even deeper into the grammatical concepts that dictate good writing.

As involvement grows, students have bolstered their reading and writing skills, and forged relationships with like-minded Arabic-speaking students and faculty. In both cases, this type of cooperation further enhances cross-level linguistic interactions that can strengthen ties within the larger UChicago Arabic speaking community.
We have developed a burgeoning student interest group in the campus community, and we have facilitated cultural connections between graduate students, undergraduate students, and Arabic speakers on campus in general.

The novel coronavirus, SARS-CoV-2, and the disease it causes, COVID, have transfixed the global community, as leaders and citizens seek to respond to a threat whose dimensions are neither entirely certain nor entirely known.
Members of the scientific community around the world are stepping up to find answers to the many questions the pandemic raises. Arguably, no expert community has a more important role to play in finding the solutions the world needs and communicating trustworthy information to the public. In December, a group of Chinese researchers published the genetic sequence of the new virus online through the Global Initiative on Sharing All Influenza Data.
That data allowed the international scientific community to start developing diagnostic tests and explore treatment options. The site now holds the genetic sequence of the virus as found in hundreds of patients across six continents. BioRxiv and medRxiv, open online repositories of not-yet-published studies in biology and health sciences, currently host more than papers on the new coronavirus. As impressive as this progress is, the world needs more, and quickly.
About the disease, too, questions remain, including why the response of patient populations to infection may differ and whether those who have been infected develop short- or long-term immunity. Researchers are racing to develop treatment options and tests that are accurate, sensitive, rapid, and locally deployable.
Epidemiologists and social scientists seek to understand which mitigation measures will be the most effective in controlling the spread of the virus; how valuable extreme measures, such as quarantines and travel bans, really are; and what consequences such policies may have on other areas of public health.
In the search for answers to these and other burning questions, every nation has something to give and something to gain.
Infectious diseases, it is commonly said, know no borders, and neither does the knowledge needed to fight them. Scientists around the world routinely share information and collaborate across borders.
The current pandemic has scientists working together on platforms such as Slack, and using new tools, such as machine learning, to rapidly detect the novel coronavirus in tests that use large amounts data from multiple sources. This outbreak has demonstrated in real time how scientific understanding can indeed be a global public good. To the extent that scientific advancements lead to new products and technologies, countries seeking to advance their own national or economic interests tend to view science more through a competitive, rather than cooperative, lens.
Drugs and vaccines can generate huge revenues. In a global pandemic, the value of open collaboration is obvious. Its usefulness in confronting other shared threats, such as climate change, should be obvious, as well.
But insularity and xenophobia cannot possibly produce an effective response to this global crisis. The magnitude of this moment calls instead for the sharing of expertise and cooperation among nations and for informed, evidence-based, coordinated responses from national governments. Fortunately, many institutions across countries and sectors have risen to meet the need. The G7 leaders met on Monday and discussed commitments to research cooperation, among other shared concerns.

The science of Islamic jurisprudence consists of a knowledge of the precepts of the Divine Legislator in their relation to human affairs. The questions of Islamic jurisprudence either concern the next world, being known as rules relating to worship, or to this world, being divided into sections dealing with domestic relations, civil obligations and punishments.
Thus God decreed the continuation of the world until the appointed time. This, however, can only occur by mankind being perpetuated which is dependent upon marriage of male and female with a view to procreation. Moreover, the continuation of the human species is assured by individuals associating together. Man, however, in view of the weakness of his nature is dependent upon food, clothing, housing and the industries for his subsistence.
In other words, in view of the fact that man is a civilized being, he cannot live in solitude like the other animals, but is in need of co-operation and association in work with his fellow men in order to live in a state of Civilization. Every person, however, asks for the things which he likes and avoids things which are disagreeable to him. As a result, it has been necessary to establish laws of a nature likely to maintain order and justice as regards marriage, mutual help and social relations, which are the basis of all civilization.
The first division of Islamic jurisprudence is the section dealing with domestic relations. The second is the section dealing with civil obligations. In view of the fact that the continuance of civilization on this basis necessitates the drawing up of certain matters relating to punishments the third section of Islamic jurisprudence deals with punishments.
